Research on Patent Infringement Liability of Online Trade Platform

Abstract：Article 36 of Tort Liability Law of the People′s Republic of China introduced Safe Harbor Rules of the United States′ Digital Millennium Copyright Act. The application of such rules in patent field is controversial. Many dilemmas in patent field are as follows： the limited examination capacity of online trade platform is difficult to cope with the complexity of patent examination； some people abuse such rules for malicious market competition. The governance model of online patent infringement shall be shifted to network user-oriented from network service provider-oriented and the rules of assuming patent infringement liability for online trade platform shall be turned to "notice-transfer-notice" from "notice-deletion" based on technicality of patent， complexity of identification for patent infringement. On the premise of not making consequential amendments to Patent Law of the People′s Republic of China， judiciary authorities shall expand explanation for "necessary measures" in article 36 of Tort Liability Law of the People′s Republic of China and make requests of assuming corresponding tortuous liability against different network service providers.
